Onionix Terms of Service

These Terms of Service ("Terms") govern your access to and use of Onionix, including the Onionix mobile application, websites, APIs, image-generation features, virtual try-on features, and related services (collectively, the "Service").

The Service is operated by HIGGS LLC ("Onionix", "we", "us", or "our"). Our contact email is higgs.core@gmail.com. Our mailing address is Uzbekistan.

Please read these Terms carefully. By creating an account, signing in, tapping "continue", generating images, uploading photos, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Onionix helps users create tattoo concepts using artificial intelligence and preview tattoo designs on photos. The Service may allow you to:

• sign in with Apple or Google;
• submit text prompts describing tattoo ideas;
• upload reference images;
• upload body photos for virtual try-on;
• generate, save, view, like, delete, and export tattoo-related images;
• access onboarding, personalization, gallery, favorites, and settings features; and
• use paid or premium subscription features.

The Service is a creative and visualization tool. It is not a tattoo studio, medical service, legal service, professional design service, or safety-certification service. Generated outputs are not guaranteed to be unique, accurate, safe for tattooing, culturally appropriate, technically suitable for skin, or suitable for any particular body placement.

Before getting a real tattoo, you should consult a licensed tattoo artist and consider health, safety, legal, cultural, and personal implications. Tattoos can be permanent and may involve medical risks.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with permission and supervision from a parent or legal guardian.

You may not use the Service if you are prohibited from doing so under applicable law or if we previously suspended or terminated your account for violating these Terms.

The Service is not intended for children under 13. Do not upload photos of children or use the Service to create tattoo previews for minors unless you have all legally required rights and permissions and the use is lawful in your jurisdiction.

3. Account and Sign-In

To use certain features, you may need to sign in with Apple or Google. You are responsible for maintaining the security of your device, account credentials, and authentication sessions. You must promptly notify us if you believe your account has been compromised.

You agree that the information provided through Apple or Google sign-in, such as your email address and display name where available, may be used to create and administer your account.

We may refuse, suspend, or terminate access to the Service if we reasonably believe that your account is being used unlawfully, fraudulently, abusively, or in violation of these Terms.

4. User Content

"User Content" means content that you submit, upload, provide, create, or transmit through the Service, including text prompts, reference images, body photos, placement settings, liked items, and other materials.

You retain the rights you have in your User Content. You grant Onionix a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, process, transmit, display, create derivative works from, and otherwise use your User Content solely as reasonably necessary to operate, provide, maintain, secure, improve, and support the Service, including to:

• authenticate your requests and maintain your account;
• upload and store images;
• generate tattoo concepts and try-on previews;
• process images through artificial intelligence providers and cloud infrastructure providers;
• display your gallery, favorites, and try-on history;
• troubleshoot, prevent abuse, and maintain security; and
• comply with law and enforce these Terms.

You represent and warrant that:

• you own or have all necessary rights, permissions, and consents for your User Content;
• your User Content does not infringe or violate any intellectual property, privacy, publicity, contractual, or other rights of any person;
• you have obtained all required permissions from any person depicted in photos you upload;
• you will not upload private, intimate, sensitive, biometric, medical, or identifying images of another person without their explicit permission; and
• your User Content and use of the Service will comply with all applicable laws.

5. Generated Content

"Generated Content" means images, previews, variations, transparent tattoo assets, composites, metadata, and other outputs generated by or through the Service.

Subject to your compliance with these Terms and applicable law, Onionix assigns to you any rights we may have in Generated Content created specifically for you through the Service, to the extent such rights are transferable. You understand and agree that:

• artificial intelligence outputs may be similar or identical to outputs provided to other users;
• we do not guarantee that Generated Content is original, copyrightable, non-infringing, commercially usable, or free from third-party rights;
• you are responsible for evaluating and clearing any use of Generated Content, especially commercial use or use as a real tattoo design;
• Generated Content may contain errors, distortions, artifacts, inaccurate anatomy, misspelled text, unsafe design placement, cultural or religious symbols, or other unexpected elements; and
• the Service may refuse, modify, filter, or fail to generate content for technical, safety, policy, legal, or operational reasons.

If you use Generated Content publicly or commercially, you do so at your own risk and are responsible for obtaining any required professional, legal, or rights-clearance advice.

6. Prohibited Uses

You agree not to use the Service to create, upload, request, store, share, or promote content or activity that:

• is unlawful, harmful, fraudulent, deceptive, defamatory, harassing, hateful, extremist, or violent;
• exploits, sexualizes, endangers, targets, or harms children;
• includes non-consensual intimate imagery, sexualized images of minors, or private images of a person without consent;
• violates intellectual property, privacy, publicity, or contractual rights;
• impersonates another person or misrepresents affiliation, identity, or source;
• attempts to generate instructions for wrongdoing, self-harm, violence, or illegal activity;
• contains malware, spam, scraping, credential harvesting, automated abuse, or attempts to bypass rate limits or security measures;
• reverse engineers, probes, scans, attacks, overloads, or disrupts the Service or its providers;
• uses generated outputs to deceive others about real people, real events, endorsements, professional qualifications, or official documents;
• violates the terms or policies of Apple, Google, OpenAI, Google Gemini, cloud infrastructure providers, or other service providers used by the Service; or
• otherwise interferes with the safety, integrity, or normal operation of the Service.

We may remove content, disable features, suspend accounts, or report activity to authorities when we believe it is necessary to protect users, third parties, Onionix, or the public.

7. Artificial Intelligence and Third-Party Providers

The Service uses third-party providers to support authentication, subscriptions, cloud storage, networking, and artificial intelligence processing. These providers may include Apple, Google, RevenueCat, OpenAI, Google Gemini, Yandex Cloud Object Storage, hosting providers, infrastructure vendors, and other service providers.

When you use image-generation or try-on features, your prompts, reference images, uploaded photos, generated images, placement metadata, and related technical data may be transmitted to and processed by these providers as necessary to provide the Service.

Artificial intelligence services are probabilistic and may produce unexpected, offensive, inaccurate, infringing, or unsuitable outputs. We do not guarantee availability, quality, legality, or fitness for any particular purpose of AI-generated outputs.

8. Purchases, Subscriptions, and Trials

The Service offers paid subscription features ("Paid Features"). Paid Features may be required to access or continue using certain functionality, including generation, saving, high-volume use, premium styles, virtual try-on, or other features shown in the app.

Current subscription options include:

• Weekly subscription: USD 9.99 per week.
• Monthly subscription: USD 29.99 per month.

Prices are displayed in the app before purchase and may vary by country, currency, tax treatment, App Store territory, platform, promotional offer, introductory offer, or time. The price shown by the Apple App Store purchase sheet at the time of purchase is the controlling price.

Purchases are processed through Apple in-app purchase and may be managed through RevenueCat subscription infrastructure. We do not process or store your full payment card details. Your purchase is also subject to Apple's terms, payment rules, refund rules, cancellation procedures, and subscription policies.

Unless otherwise stated before purchase, subscriptions automatically renew until cancelled. Your Apple ID account will be charged at confirmation of purchase and again for renewal within the period specified by Apple before the end of the current billing period. You can cancel an auto-renewable subscription in your Apple ID subscription settings. Deleting the app or deleting content inside the app does not cancel your subscription.

If a free trial or introductory offer is made available, eligibility, duration, price, conversion to paid subscription, and cancellation deadline will be shown before purchase and governed by Apple App Store rules. If you do not cancel before the applicable deadline, the subscription may convert to a paid auto-renewing subscription.

You may restore purchases in the app if supported. Restoring purchases checks your Apple/RevenueCat subscription status and may re-enable the applicable entitlement for your account.

We may change, limit, add, remove, or discontinue Paid Features, subject to applicable law and platform rules. Except where required by law or platform policy, payments are non-refundable. Refund requests for Apple in-app purchases must be submitted to Apple.

9. Intellectual Property

The Service, including its software, design, interface, branding, logos, graphics, templates, prompt systems, workflows, databases, APIs, and other materials, is owned by Onionix or our licensors and is protected by intellectual property and other laws.

Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works based on the Service or any part of it.

You may provide feedback, suggestions, ideas, or bug reports. You grant Onionix a perpetual, irrevocable, worldwide, royalty-free license to use that feedback without restriction or compensation.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy, available at https://onionix.xyz/privacy. By using the Service, you acknowledge that we process personal information as described in the Privacy Policy.

11. Content Deletion and Account Deletion

The Service may allow you to delete generated images or try-on results from your account. Deleting content may remove it from active display and from certain storage locations, but copies may remain for a limited time in backups, logs, security records, provider systems, or as required by law.

You may permanently delete your account in the app through Settings → Delete Account. Account deletion is intended to remove your account and associated Service data from our systems, sign you out, and clear local authentication data on your device. Deleting your account does not cancel an Apple App Store subscription; you must manage or cancel subscriptions separately in your Apple ID settings.

Some records may remain after account deletion where permitted or required by law, including logs, security records, limited backups, billing or webhook audit data, and information held by third-party providers such as Apple, Google, or RevenueCat.

To request data access, correction, export, or other privacy-related actions that cannot be completed in the app, contact us at higgs.core@gmail.com. We may need to verify your identity before processing requests.

12. Service Changes and Availability

We may modify, suspend, restrict, or discontinue the Service or any feature at any time. The Service may be unavailable due to maintenance, provider outages, security incidents, rate limits, network issues, model changes, or other reasons.

We do not guarantee that the Service will be uninterrupted, secure, error-free, or available in every location or on every device.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if:

• you violate these Terms;
• your use creates legal, security, operational, or reputational risk;
• required third-party services are unavailable or unavailable to you;
• we are required to do so by law or platform rules; or
• we discontinue the Service or relevant features.

After termination, provisions that by their nature should survive will survive, including provisions concerning intellectual property, User Content licenses needed for prior operation, disclaimers, limitations of liability, indemnity, dispute resolution, and governing law.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND THAT THE SERVICE OR GENERATED CONTENT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

WE DO NOT WARRANT THAT GENERATED CONTENT WILL BE SAFE, ORIGINAL, LAWFUL, ERROR-FREE, SUITABLE FOR TATTOOING, ACCEPTED BY A TATTOO ARTIST, OR APPROPRIATE FOR ANY PARTICULAR PERSON, CULTURE, BODY AREA, OR USE.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONIONIX AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, PERSONAL INJURY, PROPERTY DAMAGE, OR COST OF SUBSTITUTE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO ONIONIX FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) USD 100.

These limitations apply whether claims are based on warranty, contract, tort, statute, strict liability, negligence, or any other legal theory, even if we have been advised of the possibility of damages.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

16. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Onionix and its affiliates, directors, officers, employees, contractors, agents, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• your use or misuse of the Service;
• your User Content or Generated Content;
• your violation of these Terms;
• your violation of law or third-party rights; or
• your real-world use of any tattoo design, preview, or generated image.

We may control the defense of any matter subject to indemnification, and you agree to cooperate with us.

17. App Store Terms

If you downloaded the Service from the Apple App Store, you acknowledge and agree that:

• these Terms are between you and Onionix, not Apple;
• Apple is not responsible for the Service or its content;
• Apple has no obligation to provide maintenance or support for the Service;
• Apple is not responsible for claims relating to the Service, including product liability, legal compliance, or intellectual property claims;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you; and
• your use of the Service must comply with the Apple Media Services Terms and applicable App Store rules.

Similar platform-specific terms may apply if the Service is distributed through another app store or platform.

18. Export, Sanctions, and Local Law

You may not use the Service in violation of export control laws, sanctions, embargoes, or other applicable restrictions. You represent that you are not located in, organized under the laws of, or ordinarily resident in a country or territory subject to comprehensive sanctions, and that you are not listed on any restricted-party list where such use would be prohibited.

You are responsible for ensuring that your use of the Service and Generated Content is lawful in your jurisdiction.

19. Governing Law and Disputes

These Terms are governed by the laws of Uzbekistan, without regard to conflict-of-law principles.

Subject to any mandatory consumer protection rights that apply to you, any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts located in Uzbekistan, and you consent to the jurisdiction of those courts.

If you are a consumer, you may also have rights under the laws of your country or region that cannot be waived by contract.

20. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice by reasonable means, such as in-app notice, website notice, or email where available. The updated Terms will be effective when posted or when otherwise stated.

Your continued use of the Service after the updated Terms become effective means you accept the updated Terms.
